ANFI condemned by Court nº 1. Floating Contract and return of 9,526 pounds. Apr 20, 2018

This particular case was a partial estimation, which means that not everything that was asked by the lawyer and the client was granted. This hearing was held in Maspalomas, and the judgment was issued straight after the Preliminary Hearing. The court declared the nullity of the contract due to the perpetuity clause that was in the contract and the client also received the return of their monies back, once the deducted compensation had been established by the Supreme Court. However, they were not granted their monies back that they had paid in advance. The clients could not prove when the advanced monies had been paid, even though the payment had been made on the day that the clients signed their contract.
